International Shipping Terms & Conditions
1. Customs, Duties & Taxes
When ordering from Prosperity Japan Inc., the customer is responsible for ensuring that the purchased products can be legally imported into the destination country.
The recipient is considered the Importer of Record and must comply with all laws, regulations, and requirements of the destination country.
Orders shipped outside Japan may be subject to import taxes, customs duties, VAT, brokerage fees, and handling charges assessed by the customs office or government authorities of the destination country. These charges are imposed once the shipment arrives and must be paid by the recipient. Prosperity Japan Inc. has no control over these charges and cannot predict their amount.
Some customs offices may require the importer to provide identification, permits, or additional documents before releasing the shipment. Customs policies vary widely by country, and customs clearance procedures may cause delays beyond original delivery estimates.

DHL can provide guidance regarding duties, tax estimates, clearance procedures, and required forms.
2. Restricted or Prohibited Items
The recipient is fully responsible for ensuring that the purchased products are not classified as prohibited or restricted items in the destination country.
If items are delayed, confiscated, seized, denied entry, or destroyed by customs due to regulatory reasons, Prosperity Japan Inc. bears no liability for losses, delays, or damages.
In such cases, no refund of product value or shipping charges will be issued.
3. Consequences of Non-Payment of Import Fees
If the recipient refuses or fails to pay import taxes, duties, or customs fees:

The shipment may be delayed, returned, confiscated, or destroyed by customs.

In many countries, customs automatically destroy unclaimed or unpaid parcels.

Prosperity Japan Inc. cannot issue refunds for products or shipping fees in any case involving non-payment of duties.
All import-related obligations rest solely with the recipient.
4. Liability Regarding Import Taxes, Duties & Fees
Prosperity Japan Inc. disclaims all liability for:

customs duties
-
brokerage or handling fees
-
VAT and government-imposed charges
-
any additional costs arising from customs inspections or regulatory actions
Prosperity Japan Inc. is not liable for delays, losses, confiscation, or destruction of shipments resulting from customs inspections, non-payment of import fees, or government authority actions.
5. Transfer of Ownership and Risk After Shipment
Once the ordered items are delivered to the designated shipping carrier (DHL) in Japan:

Ownership and all associated risk—including loss, damage, or delay—transfer to the recipient.

DHL becomes responsible for the transportation and final delivery of the shipment.
Prosperity Japan Inc. is not responsible for any issues that occur after the carrier takes possession of the shipment.
6. Refunds and Returns
Customers who receive their items may request a return in accordance with the Prosperity Japan Inc. Refund Policy.

Returned items will be inspected before any refund is issued.

Refunds are processed only if items meet the return conditions.

Customers are responsible for all return shipping costs and safe packaging.

Items that fail inspection or violate return conditions will not be refunded.

7. Non-Returnable Items
Due to regulatory, safety, or hygiene reasons, the following items cannot be returned or refunded under any circumstances:

Used, or damaged items

Custom-made, personalized, or made-to-order items

Sale items, clearance items, or limited-edition products
Non-returnable items sent back to Prosperity Japan Inc. will be disposed of without refund.
8. Non-Payment of Duties & Non-Refundable Shipping Fees
If a shipment is returned to sender or otherwise fails to deliver due to non-payment of customs duties or import fees, the following apply:

Outbound shipping fees are non-refundable.

Return shipping fees (typically equal to the outbound cost) are also non-refundable.

Both fees will be deducted from any eligible refund of the product value.
If customs destroys the package due to unpaid fees or legal issues, no refund of any kind will be issued.
9. Fraud Prevention & Order Security
Prosperity Japan Inc. reserves the right to:

Request identity verification

Cancel or hold orders suspected of fraud

Restrict or deny shipping to specific countries or regions
-
Refuse transactions at its sole discretion
These measures protect both the customer and the company.
10. Force Majeure
Prosperity Japan Inc. shall not be held liable for delays or failures caused by circumstances beyond its reasonable control, including but not limited to:

natural disasters (earthquakes, floods, typhoons)
-
war, conflict, or terrorism
-
government restrictions or import/export controls
-
pandemics or public health emergencies
-
transportation disruptions, strikes, or system failures
11. Limitation of Liability
The maximum liability of Prosperity Japan Inc. for any claim related to purchased goods is limited to the total purchase price of the items.
Prosperity Japan Inc. shall not be liable for:

indirect or consequential damages
-
lost profits or business losses
-
incidental or punitive damages
12. Governing Law & Jurisdiction
These terms are governed by the laws of Japan.
All disputes arising out of or relating to these terms shall be submitted to the exclusive jurisdiction of the Tokyo District Court (or Tokyo Summary Court) as the court of first instance.
13. Privacy
International shipments may be opened and inspected by customs or postal authorities.
Prosperity Japan Inc. may provide shipment details (product names, values, invoices) to DHL, and DHL may share this information with customs authorities to comply with legal requirements.
If the order is a gift, customs regulations require that product value must still be declared.
